1. Agreement to Terms

By accessing or using Out (the "Service") provided by Out, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

Out is a social media management platform that allows users to:

Connect their social media accounts through OAuth authentication
Import existing content from connected social media accounts
Schedule and publish content to connected social media accounts
Upload and manage new content directly through the platform

The Service currently supports integration with TikTok, YouTube, and Instagram platforms. Additional platforms may be added in the future. Users are limited to connecting a maximum of five (5) social media accounts to the Service.

3. Account Registration and Security

3.1 Account Creation

To use Out, you must create an account. You must be at least 13 years old to create an account and use the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Immediately notifying us of any unauthorized use of your account
Ensuring that you log out from your account at the end of each session

4. User Content

4.1 Content Ownership

You retain all ownership rights to the content you upload, import, or create through the Service ("User Content"). By using Out, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display your User Content solely for the purpose of providing and improving the Service.

4.2 Content Restrictions

You agree not to upload, import, or schedule content that:

Infringes on any intellectual property rights
Contains malicious code or malware
Violates any applicable laws or regulations
Contains hate speech, harassment, or explicit material
Promotes illegal activities
Impersonates others

5. Third-Party Services

The Service currently integrates with TikTok, YouTube, and Instagram
Users may connect up to five (5) social media accounts total
There are no limits on the amount of content that can be imported or scheduled
There are no restrictions on post scheduling frequency Our Service integrates with third-party social media platforms. By using Out, you:
Agree to comply with each platform's terms of service
Acknowledge that we are not responsible for any changes to third-party platforms that may affect the Service
Understand that we do not control the privacy practices of these platforms

5.2 OAuth Authentication

You authorize us to:

Access your social media accounts through OAuth
Import and manage content on your behalf
Store necessary access tokens securely

6. Privacy and Data Security

6.1 Privacy Policy

We collect and use your information as described in our Privacy Policy at https://out.so/legal/privacy. By using the Service, you agree to our privacy practices.

6.2 Data Retention

We retain all imported and uploaded content indefinitely until you delete your account
Account deletion will permanently remove all your imported and uploaded content
We reserve the right to remove any content at our discretion
Account termination, whether initiated by you or us, will result in the permanent deletion of all associated content

7. Service Modifications and Pricing

7.1 Service Changes

We reserve the right to:

Modify or discontinue any part of the Service
Add or remove supported social media platforms
Change account limits and restrictions
Update these Terms at any time

7.2 Pricing and Notifications

The Service is currently offered free of charge. We reserve the right to:

Introduce paid subscription tiers in the future
Modify the features available in free and paid tiers
Change pricing with reasonable notice to users
Offer promotional pricing or special offers

Users will be notified via email of any changes to the Service's pricing structure, including the introduction of paid tiers.

8. Termination

8.1 Account Termination by User

You may terminate your account at any time by following the instructions on the Service.

8.2 Account Termination by Out

We may suspend or terminate your account at any time and without prior notice if:

You violate these Terms
We are required to do so by law
We believe your actions may cause harm to other users or our Service
We decide, in our sole discretion, that your continued use of the Service is not in the best interests of the platform

Account termination will result in:

Immediate loss of access to all Service features
Permanent deletion of all imported and uploaded content
Revocation of all OAuth connections to social media platforms

We are not required to provide a reason for account termination, and we reserve the right to refuse service to anyone at our discretion.

9. Limitation of Liability

To the maximum extent permitted by law, Out, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.
